Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to answer human smuggling charges, he was held in federal custody.
In her decision, the judge pointed out that the authorities lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
